Should I be worried about this?

a month ago I bought something on ebay that still didn't arrive here after 4 weeks of purchased... and now I got a refund from ebay.. will the seller try to do something? he never provided shipping to me.. never replied to my messages.. and I will return his ps2 if it EVER ARRIVES TO HIM... can he do something if ebay made the final decision about an undelivered item?
